General Terms and Conditions of Business and Delivery of the company H & S Bike Discount GmbH
according to the German Civil Code (BGB)

Payment & Shipping

A) How to order from us

1. Order
   We offer you the possibility to order conveniently from our online shop. You will have the option of concluding the purchase contract in German, English, French, Spanish or Italian.

2. Payment options

   1. By Cash on delivery
      Cash on delivery shipping is handled by DHL. You pay directly to the postman upon receiving the goods. Please note that in addition to the surcharge of 4,- Euro, a postal fee of 2,- Euro will be charged by the delivery agent. Cash on delivery is only possible within Germany.

   2. By payment in advance
      When ordering by payment in advance, the ordered goods will be sent as soon as the invoice amount is credited to our bank account.

   3. By credit card / PayPal / Sofortüberweisung
      We offer our customers the possibility to pay via Mastercard or Visa credit card as well as via PayPal and Sofortüberweisung.

   4. By financing
      We offer our customers the possibility of financing the purchase via Targobank, provided that the requirements are met. Only eligible for customers residing in Germany.

   5. By voucher
      Please note that vouchers cannot be paid out and that the voucher amount (in case of several vouchers: the sum of all vouchers) may not be higher than the order value.

      Note: Please enter an e-mail address when placing your order. You will then automatically receive a confirmation that your order has been received along with all the necessary instructions for the desired payment option.

3. Delivery
   Shipping is carried out via DHL or DPD. In Germany and many European countries you can choose freely between both logistics partners. However, cash on delivery shipments can only be carried out with DHL. Of course we deliver the orders to your home. Should the delivery person not be able to reach you, you will be notified in writing. You then have the choice of having the goods delivered again or collecting the package from a depository near you.
   Partial deliveries are permitted if unavoidable.
   Additional customs duties, taxes and fees apply for deliveries to non-EU countries.

B) Cancellation policy, transport related damages and data protection

1. Consumer's right of withdrawal
   Consumers shall have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes which can predominantly be attributed neither to their commercial nor to their independent professional activity.

   Cancellation policy

   Consumers have a fourteen-day right of withdrawal.

   Right of withdrawal

   You have the right to cancel this contract within fourteen days without specifying any reasons. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the last goods.

   In order to exercise your right of withdrawal, you must inform us (H & S Bike Discount GmbH, Konrad-Zuse-Straße 20, 53501 Grafschaft, Germany, [email protected], telephone: 49 (0) 2641 - 89 00 0 by means of an unequivocal statement (e.g. by letter delivered by post or an e-mail) of your decision to withdraw from this contract. You may use the sample revocation form enclosed for this purpose, which is, however, not mandatory.

   It is sufficient to send the notification about exercising the right of withdrawal before the expiry of the withdrawal period in order to comply with the withdrawal deadline.

   Effects of the withdrawal

   If you withdraw from this contract, we are obliged to refund all payments we have received from you, including delivery costs (with the exclusion of any additional costs arising from the fact that you have chosen a type of delivery other than the most economical standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we have received your notification of withdrawal from this contract. For this refund, we will use the same means of payment used by you in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this refund. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

   You shall bear the actual costs of returning the goods. For goods that are not suitable for parcel shipment such as bicycles (forwarding agent) and bicycle batteries (hazardous goods) and cannot be returned by normal post / DHL due to their characteristics, these costs shall amount to 35 euros for collection by a forwarding agent.

   Special return costs for Germany, Belgium, Denmark, France, Luxembourg, the Netherlands and Austria:
   Return costs from the above-mentioned countries will be borne by us if the value of the returned goods exceeds 50 euros.

   You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

   You will only have to pay for any possible decrease in value of the goods if this decrease in value is attributable to handling the goods in a way that is not necessary for the inspection of the condition, properties and functioning of the goods.

   Special notes
   If you are financing this contract by means of a loan and later revoke it, you are also no longer bound by the loan agreement, provided that both contracts represent one economic unit. This is particularly to be assumed in case we are also your lender or if your lender makes use of our services with regard to the financing.

   If we have already received the money from the loan when the revocation becomes effective, your lender shall assume our rights and obligations under the financed contract in relation to you with regard to the legal consequences of the withdrawal or the return.

   The latter does not apply if the subject of this contract is the acquisition of financial assets (e.g. shares, foreign exchange or derivatives).

   If you want to avoid a contractual obligation as far as possible, please make use of your right of revocation and also withdraw from the loan agreement if you are entitled to do so as well.

2. Damage in transit/claims
   We ask our customers to report apparent defects within one week. In the case of transport damages which are already visible by appearance, we ask you to check the package immediately and to have a damage confirmation issued by the transport company in any case.

3. Dispute resolution
   Alternative dispute resolution in accordance with Art. 14 (1) ODR Regulation and § 36 VSBG: The European Commission provides a platform for online dispute resolution (OS), which can be found at http://ec.europa.eu/consumers/odr/ We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

4. Data protection
   Please find information on data protection here.

The display of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. By clicking the button „Order subject to payment“, you are submitting a binding order for the goods in the shopping basket. You will receive a confirmation that we have received your order immediately after you have submitted it and this does not constitute any acceptance of the contract. We can accept your order by sending an order confirmation via e-mail or by delivering the goods within five days.

C) Promotional vouchers

The voucher code must be entered in the voucher field on the „Shipping/Payment“ page during the order process and confirmed by clicking on the „Redeem“ button.

Should you return items from a promotion and fall below the order value necessary to meet the promotional bonus, the promotion will be invalidated and the entire amount of the credit will be forfeited.
Please also note that subsequent redemption of the voucher code is no longer possible for technical reasons.

Unless otherwise stated, the voucher code can be redeemed until 24:00 (CET) on the last day of the promotion.
